Türkiye's GYO basket: the 0%-withheld dividends are real — but whether they are paid is the developer's choice

Türkiye's listed property sector (GYOs) has this wave's cleanest tax shape: corporate-tax exemption with dividends withheld at 0% — for residents and non-residents alike, with KAP distribution notices stating it verbatim ('our company has GYO status, so the income-tax withholding rate is 0%'): gross equals net. Basket readings: Emlak Konut's FY2025 dividend of TRY 0.60 per share (KAP-verified, TRY 2.28B total, 37.3% of net distributable profit) is 3.4% at the TRY 17.66 price; Torunlar's LTM yield is about 4.85% (its FY2024 TRY 3.50 per share at about a 41% payout is KAP-verified). But this site prints its condition in the title, because GYO dividends are discretionary developer profit-shares, not rent pass-throughs: Torunlar paid nothing for four straight years (2019–2022, then 0.20 → 2.35 → 3.50 on the way back), and İş GYO, one of the largest names, is institutionally estimated to pay 0% in both 2025 and 2026. The law is tightening the discretion: Law 7524 conditioned the tax exemption (from 2025 income) on distributing at least 50% of own-property gains within two months of period-end, and MHR GYO's FY2025 notice already computes on that basis — but its first full cycle is only now printing, unverified in effect. The anchor's nature also needs naming: Emlak Konut is in substance Türkiye's largest homebuilder, so its dividends follow the housing cycle, not the rent cycle. Finally, the currency: 3.4–4.9% nominal in lira against 29.77% official inflation (independent estimate 45.12%) is deeply negative in real terms — verdict: do, on conditions, the condition being that it is priced as a lira asset with interruptible dividends, not as high-yield rent income.

The biggest catch

Discretionary distribution is this entry's defining risk: in the Law 7524 transition, large names can still lawfully pay zero — the tax condition binds a definition of property gains, not the investor's receipts.

The numbers that matter

3.4–4.9%

Why we think it makes money

The 0% withholding has a double lock (the tax guide table plus the KAP notice wording) — Türkiye is the only jurisdiction on this site where 'gross equals net' needs no assumption, provided a dividend is paid at all.

Law 7524 is a live institutional experiment: if the 50% distribution condition is fully enforced and sustained, GYO dividend discretion gets compressed by law — this site tracks its first cycle's prints as this entry's core follow-up, which is forward information, not historical baggage.

Liquidity floors the risk: about 50 listings with TRY 2.76B of daily turnover at the top — entry and exit costs in Türkiye's basket are emerging-market best-in-class, so there is no instrument risk on top of the discretion risk.

How to actually get in

  1. Listed route: buy the basket (EKGYO as the liquidity anchor, TRGYO as the restored-payer specimen) through a broker with BIST access, in any amount, with no foreigner restriction; dividends arrive with zero withholding and no reclaim process.

Risks: what could go wrong

Discretionary distribution is this entry's defining risk: in the Law 7524 transition, large names can still lawfully pay zero — the tax condition binds a definition of property gains, not the investor's receipts. If these happen, our take changes: If Law 7524's first full cycle (2025 income, the 2026 distribution season) shows the large GYOs broadly distributing on the 50% basis, this entry's stability score is raised.
Negative real returns: nominal lira yields of 3.4–4.9% against official inflation of 29.77% (with a higher independent estimate) — in hard-currency terms this is an inflation-hedge option, not income. If these happen, our take changes: Reviewed yearly against TurkStat and ENAG inflation prints and the lira; if inflation falls to single digits with a stable lira, this entry is rescored.
The anchor's developer nature: Emlak Konut's profits come from development and revenue-share projects, so its dividend contracts ahead of rent-type REIT payouts in a housing downturn. If these happen, our take changes: Checked yearly against KAP distribution notices.

FAQ

At 0% withholding, why doesn't it outrank Korea's REITs (entry No. 75)?
Because tax is only one link in the receipt chain: Korea's 15% is withheld from a numerator the law compels (over 90% distribution); Türkiye's 0% applies to a numerator that can be zero. Zero percent of uncertain beats not fifteen percent of compelled — that inequality is the two entries' ranking. If Law 7524 compresses discretion into obligation, Türkiye's rank gets reassessed; the trigger is printed.
Does Law 7524's 50% condition mean dividends are now assured?
No. The condition binds 50% of a tax-defined concept ('gains from owned real estate'), and its sanction is losing the exemption on that income — not a court order to pay. How development-heavy GYOs' profit mixes map onto that definition is being worked out in the first cycle. This site's phrasing is 'discretion being compressed by law, not yet fully compressed' — read the printed notices, not the statute's aspiration.
What is a lira asset for, for a Singapore-based reader?
Honestly: most readers don't need one. It is on this site for completeness (a liquid, tax-clean major market cannot be absent) and for its calibration value — it prices the combination 'zero withholding plus high inflation'. If held at all, it is an option on lira stabilisation, sized as a currency position with dividends budgeted as interruptible — which is the entirety of this site's usage note for it.
